(Recommended reading for Indonesian Employee)
There are many ways to do this, but lets discuss the best way to tender your resignation:
Settle your Obligation to the company:Submit your resignation in one month notice period (as per Labor Law 13/2003) unless stated otherwise on your Collective Workers Agreement.
Send your resignation letter to your direct line manager copy to your HR Department. You need to get them both sign on your copy of resignation letter as proof that you have submit your letter on the specific date. This needs to be done to ensure that the one month notice starts when you are submitting your letter.
Ask your Rights to the company:
- Your leave balance, you should check your leave balance, so you are aware of the issue behind this:
- You can either take the leave balance on the last days of the one month notice period, meaning that your last day of you effectively work for the company is one month minus your leave balance.
- If company hold you and not approving your leave to be taken on the last days of your one month notice period, company MUST pay you the leave.
By right the leave days should be calculated based on working days, meaning :
your salary (XXXX) / working days for the month x your leave balance
- Compensation of work services, for employee who has worked for more then 3 years, as per regulation will get this money. Check with your HR on this one.
Prepare and list down written letter including questions to the company to settle obligation and getting the rights.
Why?
This is for benefit of both employee and employer to avoid dispute in the future. What are the questions:
- When will your last salary be transferred?
- You want to take your leave balance at last days of your one month notice.
- What other payment will you get from the company:
a. Compensation of work services (condition applies)
b. Tax Adjustment when you resign in part of the fiscal year.
c. THR / Festive Allowance, if you resign near to the festive season eg christmas and hari raya. This paid one week beforethe Holy Day as per regulation.
Best way is to get all in written to avoid dispute in the future and good for both parties.
By this all sequently written down, there are no ways for company to hold you from resigning or from holding your last payment, or the letter can easily be used for you to go to Manpower Ministry and report the company of their wrong action and same thing for the company, the letter is for them to defend themselves from employee.
